Judicial Panel of Multi District Litigation Transfers Infant Formula Multi District Litigation to Northern District of Illinois

(CHICAGO, IL)…For nearly two years, attorneys from across the country have been waging a war against Abbott Laboratories and Mead Johnson, alleging that certain formulas marketed for premature babies were unreasonably dangerous and known to increase their chance of developing life-threatening gastrointestinal issues.

Elizabeth Kaveny, managing partner of Kaveny + Kroll, is thrilled to announce that as of today, April 8, 2022, the Judicial Panel of Multi District Liitigation (JPML) has transferred the Infant Formula Multi District Litigation (MDL) to the Northern District of Illinois, where it will be supervised by Chief Judge Rebecca Pallmeyer.

Kaveny + Kroll has been fighting these cases against Abbott and Mead Johnson since their inception and will be happy to fight for premature babies here in our home state. Cases have been filed not only throughout the state of Illinois, but throughout the entire United States.

One in ten babies are born prematurely (prior to 37 weeks gestation) and over 1 million die each year due to complications. The care and feeding of premature babies is a delicate balance and often requires baby formula to supplement. Feeding infant formula to premature babies while hospitalized should be a safe practice. Yet, while Enfamil and Similac create highly caloric, cow’s milk products designed for prematurity, it is anything but safe! Lawsuits filed allege that products made by Enfamil and Similac put preemies at an increased risk for a life-threatening condition called Necrotizing Enterocolitis (NEC).

Today, parents are filing lawsuits against formula manufacturers including Abbott Laboratories, Inc. (Abbott) and Mead Johnson & Company and LLC, Mead Johnson Nutrition Company (Mead Johnson), manufacturers of the formulas, for injuries and deaths to their babies.
